End-User License Agreement

This End-User License Agreement (“Agreement”) is made between you (the individual or legal entity, hereinafter referred to as “Customer” or “You”) and Mavenbird Technologies Private Limited (“Mavenbird”, “We”, “Us”, or “Our”). This Agreement governs your use of any software, scripts, services, or documentation (collectively, the “Software”) purchased or obtained from Mavenbird.

By purchasing, installing, or using the Software, You acknowledge that You have read this Agreement, understood its terms, and agree to be legally bound by them.

1. Grant of License

Subject to the terms of this Agreement, Mavenbird grants You a non-exclusive, non-transferable license to install and use one copy of the Software on a single Magento installation for your personal or business e-commerce use.

• A separate license must be purchased for each additional Magento installation.
• Any use beyond this scope requires a custom-priced license from Mavenbird.

2. Ownership and Copyright

Mavenbird is the sole owner and copyright holder of the Software. The Software and its components are protected by copyright and other intellectual property laws. You may not copy, modify, or redistribute the Software except as expressly permitted in this Agreement.

3. Restrictions

You agree you will not, without Mavenbird’s prior written consent:

1. Use the Software for projects, research, analytics, or marketing outside the licensed Magento instance.
2. Modify, sell, distribute, sublicense, rent, lease, or lend the Software or its documentation.
3. Integrate any part of the Software into other products, platforms, or websites outside Magento.
4. Make the Software accessible on a public network for distribution purposes.
5. Remove, alter, or obscure any Mavenbird branding, copyright notices, disclaimers, or proprietary marks.
6. Obscure or remove the copyright text/link included in templates supplied by Mavenbird.

4. Liability and Disclaimer

The Software is provided “as is” without warranties of any kind, express or implied. Mavenbird shall not be liable for any damages, including but not limited to loss of profits, business interruption, data loss, or legal liabilities arising from the use of or inability to use the Software.

You are responsible for ensuring your use of the Software complies with all applicable laws and regulations.

5. Termination

This Agreement remains in effect until terminated. Mavenbird may revoke or terminate your license at its sole discretion if You breach any terms of this Agreement.

You may terminate this Agreement by permanently deleting all copies of the Software. Termination does not entitle You to any refund. Continued use after termination is unauthorized and may result in legal action, including recovery of damages and attorney fees.

6. Changes to Agreement

Mavenbird reserves the right to update or modify this Agreement at any time. Continued use of the Software after changes constitutes acceptance of the revised terms.

7. Miscellaneous

Mavenbird reserves the right to publish a list of selected users of the Software. Mavenbird will not be liable for any illegal use or prosecution arising from misuse of the Software. If Mavenbird incurs costs due to your misuse (including reasonable attorney fees), You agree to reimburse Mavenbird for such costs.
